Terms of Service

These Terms of Service ("Terms") govern your use of the Hiyokopy desktop application ("the App") provided by hiyoko.fun ("we", "us", "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

The Mac App Store distribution is additionally governed by Apple'sLicensed Application End User License Agreement. In the event of a conflict, Apple's terms apply for the Mac App Store version where required.

1. License

We grant you a non-exclusive, non-transferable, revocable license to use the App on devices that you own or control, subject to these Terms.

Free version

The Free version may be used by anyone, for personal or commercial purposes, on any number of devices, with no time limit.

Pro purchase

The Pro tier is sold as a one-time, non-consumable In-App Purchase via the Mac App Store. There is no subscription and no recurring charge. Pro is tied to the Apple ID used at purchase and can be restored via the in-app Restore Purchase button. Pro is not transferable between Apple IDs, and does not carry over between the Mac App Store and the future Microsoft Store version.

2. Restrictions

You may not:

• Resell, sublicense, rent, lease, or distribute the App to third parties.
• Reverse-engineer, decompile, or disassemble the App, except as expressly permitted by law.
• Remove or modify any copyright, trademark, or proprietary notices.
• Circumvent the Pro feature gating to access Pro functionality without a valid Mac App Store purchase.
• Use the App for any unlawful purpose or in violation of these Terms.

3. Updates

We may provide updates at our discretion via the Mac App Store. We do not guarantee that any specific feature will be maintained indefinitely, but we will not remove Pro features that were advertised at the time of your purchase without offering a comparable replacement.

4. Data and Privacy

The App stores all clipboard history and settings locally on your device. We do not have access to this data. See our Privacy Policy.

5. Refunds

Refunds are handled by Apple, not by us. See reportaproblem.apple.com.

6. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. You use the App at your own risk.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATING TO YOUR USE OF THE APP. Our total cumulative liability shall not exceed the amount you paid us for the Pro purchase via the Mac App Store.

8. Termination

We may suspend access to Pro features if you breach these Terms. The Free version remains available. Because Pro purchases are managed by Apple via StoreKit, we cannot directly revoke an individual purchase; in cases of demonstrated abuse we may request Apple to take action under Apple's policies.

9. Governing Law

These Terms are governed by the laws of Japan, without regard to its conflict-of-law rules. Any disputes shall be resolved in the courts of Japan, unless mandatory consumer-protection laws of your country of residence provide otherwise.

10. Changes to These Terms

We may revise these Terms from time to time. The "Effective date" indicates the latest revision. Continued use after a revision constitutes acceptance of the new Terms.
